These Terms & Conditions (“Terms”) are a legally binding agreement between you (the player) and Caps Studios Ltd (“Caps Studios”, “we”, “us”, or “the Company”), the developer and operator of Caps Slam (the “Game” or “Capss”). By downloading, accessing, or playing Capss, you agree to these Terms. If you do not agree, you must not use the Game.

Capss(Caps Slam) is a skill-based collectible mobile game available on iOS and Android (with a web version possibly coming later). It’s important to understand the rules of the Game, how our in-game purchases and random drops work, and what is expected of you as a player. We’ve structured these Terms to be clear and straightforward, much like the approach used by similar games. Please read these sections carefully:

  • Eligibility & Accounts: Who can play, age restrictions, and account creation.
  • Virtual Items & Purchases: How in-game currency and purchases work (premium passes, “gum” refills, cosmetics, etc.), including disclosure of loot box drop rates.
  • Gameplay Rules and Code of Conduct: The dos and don’ts of using the Game (no cheating, exploiting bugs, fair play, etc.).
  • User Content & Interaction: If applicable, guidelines on trading and communication between players.
  • Intellectual Property: Ownership of game content and what you can/cannot do with it.
  • Termination: How you or we can terminate an account or access.
  • Disclaimers & Liability: Important legal protections and limitations.
  • Governing Law & Dispute Resolution: The laws that govern these Terms and where disputes will be resolved.

We’ve tried to keep it user-friendly, but this is still a legal document. If you are a minor, please have a parent or guardian review these Terms with you.

1. Eligibility and Age Requirements

  1. Minimum Age: You must be at least 13 years old to create a Capss account and play the Game. If you are under the age of 13, you are not permitted to use Capss without parental consent. Children under 13 may only play under the supervision of a parent or legal guardian who has reviewed and agreed to these Terms. Caps Studios does not knowingly allow unauthorised children under 13 to create accounts.

  2. Minors Between 13 and 18: If you are between 13 years old and the age of legal majority in your country (which is 18 in the UK and Cyprus), you affirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf, and that you have their permission to play. Minors must ask their parent or guardian to review and accept these Terms and the Privacy Policy before playing or making any purchases. We strongly encourage parents/guardians to supervise the gameplay and purchases of their minors.

    By using the Game, you (and your parent/guardian if you are a minor) agree that you will abide by these Terms. Parents/Guardians: If you permit a minor to use the Game, you are responsible for the minor’s activity on the Game. This means you assume responsibility for any purchases made in the Game by that minor and for ensuring the minor’s compliance with these Terms.

    If you are a parent or guardian and you do not agree to these Terms, do not allow your child to use the Game.

  3. Account Creation: To access certain features (such as saving progress, online play, or participating in events), you may need to create an account with Capss. You can either register directly using your email address and a secure password, or log in using a supported third-party service such as Google, Facebook, or Apple.

    By using a third-party login, you authorise us to access certain basic information (such as your email address or user ID) in accordance with our Privacy Policy. You agree to provide accurate information and not to impersonate anyone or create multiple accounts for disruptive purposes.

    You are responsible for maintaining the confidentiality and security of your login credentials, whether through direct registration or third-party login. You must not share your account or allow others to access the Game through your credentials. You remain liable for all activity carried out under your account.

  4. One Account Per Person: Each player should have no more than one account, unless we explicitly allow alternate accounts for specific reasons (for example, separate accounts on different platforms). Accounts are personal and non-transferable. You may not sell, gift, or trade accounts, and any such attempt is a violation of these Terms.

  5. Eligibility in Specific Regions: You are responsible for ensuring that your use of the Game is in compliance with all local laws. If you are in a region where the Game is not officially available or is prohibited, you should not use it. We reserve the right to restrict access to the Game in certain countries or for legal compliance reasons.

2. In-Game Currency and Purchases

Capss is free to download and play. However, the Game offers optional in-game purchases. This section explains how our in-game currency and purchases work, and the monetisation elements like the premium pass, “gum” refills, cosmetics, and trade energy boosts.

  1. In-Game Currency (“Gold Caps”): The Game uses a virtual currency “Gold Caps” which you can purchase with real money (fiat currency). Purchasing Gold Caps is entirely optional but allows you to acquire various in-game goods. Please note: Gold Capss have no real-world monetary value. They are digital points that exist only within Capss. You can not convert Gold Capss back into cash or any real commodity, and they are non-refundable except as required by law or at our discretion. Gold Caps cannot be traded or transferred between players or accounts (except via official in-game mechanics if any; but you cannot sell them for real money or exchange outside the game).

    When you purchase Gold Caps through the Apple App Store or Google Play Store, you are paying those platform providers, and they in turn grant you the Gold Caps in-game. All such purchases are subject to the app store’s payment terms and possibly taxes. Caps Studios does not receive your credit card information. We do record the amount of Gold Caps credited to your account.

  2. Virtual Goods: You can use Gold Caps (or sometimes earn certain items through gameplay) to acquire various virtual goods in Capss. These include:

    • Premium Pass: The Premium Pass is a non-recurring digital access pass that can be purchased for a specific game month. It grants access to exclusive in-game rewards, cosmetic content, and progression benefits during that month. Purchasing the Premium Pass later in the month will retroactively unlock previously missed premium rewards. This is a separate, non-refundable digital purchase. All Premium Pass content is digital-only. Premium Pass benefits expire at the end of the month.

    • “Gum” Refills: In Capss, “Gum” might refer to an energy mechanic or a resource that limits certain actions (for thematic flavour, imagine an energy or stamina called gum). Gum Refills are purchases that refill your energy or give you additional immediate in-game resource. Essentially, if you run low on whatever resource is needed to continue playing or trading, a Gum Refill purchase will top it up. This lets you keep playing without waiting for natural regeneration. Gum Refills provide no advantage other than saving time – they don’t make the game easier, just faster.

    • Cosmetics: These are purely visual items that let you customize your experience. Examples include character hands, avatars, slammers, or special visual effects for your profile. Cosmetic items do not affect gameplay or player abilities – they are for fun and personalisation. Purchasing a cosmetic might let you stand out or express yourself in-game. All cosmetic purchases are final and tied to your account.

    • Trade Energy Boosts: Capss features a trading system for collectibles (“Caps”). To prevent abuse, trades might be limited by a “trade energy” or quota system. Trade Energy Boosts are items you can purchase (or earn) that increase your trading capacity – for example, allowing additional trades. This helps active collectors trade more frequently. Trade Energy Boosts do not give you any free items; they just allow you to make more trades within the game’s rules. They are intended for convenience for dedicated players who engage heavily in trading.

    • Missed Premium Rewards:

    Players that have Premium Pass activated but have not reached specific milestones at the end of a month will not be eligible for the associated premium rewards.

    We may add or remove types of virtual goods over time as the game evolves (for instance, introducing new cosmetic categories or new boost types). We’ll update these Terms or provide in-app descriptions when that happens.

  3. Real Money Purchases and Platform Policies: When you buy Gold Caps or any in-app purchase, it will be processed by the Apple App Store or Google Play (depending on your device). All purchases are subject to the respective platform’s terms and conditions. For example, Apple may require your authentication (FaceID/TouchID/password) and might provide a short window for refund requests per their policies. Caps Studios itself does not handle your payment details or transactions outside the platform.
  4. All Sales are Final: Generally, all in-game purchases are final and non-refundable. Once you buy Gold Caps or a virtual item and it’s credited to your account, you cannot return it for a refund, except where your local law provides a right to refund. For instance, if you accidentally purchase an item, we typically cannot reverse it (because the platform has already processed it) – so please purchase carefully. However, if you encounter a genuine issue (e.g., you paid but didn’t receive the item, or a purchase was made without your authorisation), please contact our support and we will investigate case by case. In certain cases, we may, at our discretion, provide a remedy (like delivering the item, or in rare cases a refund through the platform) especially if required by consumer protection laws.
  5. Parental Permission for Purchases: If you are under 18, you must have your parent or guardian’s permission before making any purchases in Capss. For children under 13, as stated earlier, a parent/guardian should be the one to approve and initiate any purchase. We strongly urge parents to use device parental controls (like password-protecting purchases or using family accounts) to prevent unintended charges by minors. By making a purchase, you confirm that you are either (a) over 18, or (b) a minor with the valid consent of a parent/guardian to make that purchase.

    Caps Studios will not be responsible for unwanted purchases made by minors without permission. We will assume all purchases on an account are authorised. That said, if you are a parent and discover unauthorized purchases by your child, contact us immediately — we can assist in preventing further use and may guide you on seeking refunds through Apple/Google as appropriate. We adhere to all platform refund policies for such scenarios.

  6. No Cash-Out & No Real-World Trading: Capss is not a gambling or real-money trading platform. There is no cash-out feature. You cannot convert any of your virtual items or currency back into real money. There is also no official way to trade virtual items for real-world value (only in-game trade between players for mutual collection purposes). Any attempt to sell in-game items, Caps, or accounts for real money or to exchange them outside of the game is strictly prohibited. We do not recognise any such transactions and reserve the right to terminate accounts involved in real-money trading of our virtual assets. Remember: everything you acquire in game (Caps, virtual goods) is just a licensed part of the service (see Intellectual Property section) – it is not your personal property to sell.
  7. Pricing and Availability: The prices for coins or items will be as listed in the app store in your local currency. We may run promotions or sales from time to time (e.g., a holiday discount on a bundle of Gold Caps). All prices and availability of items are subject to change. If an item is mistakenly listed at an incorrect price, we reserve the right to correct it (if you somehow manage to purchase at the incorrect price, we may honour it at our discretion or reverse the transaction and refund you). Virtual items may also be obtainable via gameplay without purchase, and we may adjust drop rates or availability for balance (with notice as needed).
  8. Subscription Services: Currently, Capss does not have any auto-renewing subscription services (the Premium Pass is a one-time purchase for a month, not a recurring subscription). If in future we introduce any subscription-based services, we will clearly explain the terms (duration, auto-renewal, cancellation policy) and obtain your explicit agreement.
  9. Statutory Rights and Cooling-off: By its nature, digital content (like virtual currency or items) is delivered to you immediately when you purchase it in-game. Under some laws (e.g., EU/UK consumer laws), digital purchases might come with a “cooling-off” cancellation right of 14 days unless you consent to immediate delivery and waive that right. When you make a purchase in Capss, you acknowledge that we will provide the content immediately and thus you waive any automatic statutory cancellation right that may apply, as the service is fully delivered right away. This does not affect other legal rights to refunds for faulty or not-as-described content – we will comply with any such obligations. (In short, if the item you bought doesn’t work or isn’t delivered, we will make it right. We just can’t allow no-questions-asked cancellation after consuming the content, in line with digital content rules.)

3. Loot Boxes and Drop Rate Disclosures

Capss involves collecting virtual characters or items called “Caps”. You can obtain Caps through gameplay and by opening virtual packs (loot boxes) which contain a random selection of Caps. Transparency is very important to us, so we openly disclose the contents and probabilities for these packs, in compliance with industry standards and legal guidelines that require loot box odds disclosure. Below we explain the types of packs available and their drop rates:

  1. Pack Types and Contents: We currently offer the following pack types in the game, each containing a set number of Caps of certain rarity tiers:

    • Common Pack: Contains 6 Common Caps. (This pack is focused on common rarity items.)

    • Rare Pack: Contains 3 Rare and 3 Common Caps.

    • Legendary Pack: Contains 1 Legendary and 5 Rare Caps (This is a high-value pack.)

    When you open a pack, you will receive exactly the number and rarity of items as stated (e.g., a Rare Pack will always give 3 Rare and 3 Common Caps). The specific identity of each Cap is random, but governed by the probabilities in section 3.2.

  2. Drop Rate Distribution: Within each rarity category, the game uses a random draw system. The chance of obtaining any particular Cap of a given rarity is as follows:

    • Common Caps: Each Common Cap has a 1 in 24 chance of being drawn (which is 4,167% probability for each Common Cap per draw).

    • Rare Caps: Each Rare Cap has a 1 in 60 chance of being drawn (approximately 1.67% probability for each Rare Cap per draw).

    • Legendary Caps: Each Legendary Cap has a 1 in 12 chance of being drawn (which is 8,333% probability for each Legendary Cap per draw, given a pool of 12 total Legendary Caps in the randomiser).

    To clarify, at launch the game might have, say, 12 different Legendary Caps available in the loot pool. When you get a Legendary drop, the system will randomly pick one out of those 12 with equal 8,333% chance each, thus delivering a random Legendary. The above percentages mean, for example, if you open a pack that yields a Legendary, there’s an equal chance to get any of the 12 Legendaries in the pool.

  3. Pack Mechanics and Guarantees:

    • All Packs guarantee all slots in a pack to give only their set rarities. For example, a Rare Pack’s 3 Rare slots and 3 Common slots will all have caps of set rarities (no less or more Rare caps, and no chance of Legendary in that particular pack type).

    • We do not use any individualised odds or “dynamic drop rates” per user. The odds are fixed as above for all players and all packs. We also do not adjust odds based on purchase history (no “rigging” to encourage or discourage spending). This uniform randomness ensures fairness.

  4. Event-Only Caps: We will always make it clear which Caps are not in packs, so players know that no matter how many packs they open, those particular ones must be gained through events. This is to reward participation in gameplay events and to avoid frustration chasing an unattainable drop.
  5. Disclosure and Compliance: We disclose the above odds and contents to comply with applicable guidelines and laws. For example, UK’s Advertising Standards Authority and industry bodies require that games with paid loot boxes provide clear probability information to players. We want you to make informed decisions. These probabilities are also available in-game (e.g., on the Pack purchase screen or in the info section).
  6. Changes to Odds: The drop rates given are the initial rates at launch. We do not foresee needing to change them; however, if we ever adjust the loot pool or probabilities (for instance, adding more Caps could change the 1 in X figures, or if we balance the game), we will update this section of the Terms and the in-game disclosures. Any changes will not be done in a sneaky way – we’ll inform players via patch notes or announcements. Your continued use of the game after odds changes means you accept the new odds for future packs opened.
  7. No Purchase Necessary for Drops: Remember, loot boxes (packs) can often be obtained via gameplay rewards too (not just purchased). We might give daily free Common Packs, or event rewards including packs. The same odds apply regardless of whether a pack was bought or earned for free.

    If you have any questions or concerns about how the loot boxes work, please contact our support. We want everyone to feel the system is fair and transparent.

4. Gameplay Rules and User Conduct

We want Capss to be a fun and fair experience for all players. By playing, you agree to abide by the following Game Rules and Code of Conduct. Failure to follow these rules can result in warnings, suspension, or permanent banning of your account, as well as other legal consequences if warranted.

  1. Fair Play – No Cheating or Hacking: You must play the game fairly and only as intended by us. You agree not to use any unauthorised third-party programs or tools to gain advantage in the game. This includes (but is not limited to) cheats, bots, automation scripts, mods, hacking tools, or exploits. Examples of prohibited behaviour: using a program to play or collect rewards while you’re not actually at your device, modifying the game client or files to alter gameplay, exploiting any bugs or glitches to gain unwarranted advantage, or using tools to reveal hidden information not normally visible. You also may not attempt to reverse engineer, decompile, or disassemble the game software or any of its components. Any attempt to access the source code or underlying logic of Capss (outside of any provided modding API, which currently none exists for this game) is strictly forbidden.

    Basically, play honestly. If we detect cheating or manipulation of the game, we reserve the right to ban your account immediately (especially in competitive contexts). We may also reset progress or remove fraudulently obtained items. We aim to keep a level playing field.

  2. No Unauthorised Transactions: Aside from the official trading system for Caps within the game, you must not buy, sell, or trade accounts, Caps, or any game items for real money or outside the game. As stated, such transactions are not allowed and are unsafe. If you engage in them, we may terminate your account and the other party’s account. We also do not mediate any issues arising from such prohibited deals.

  3. User Interactions – Be Respectful: If Capss includes features that allow communication between players (such as chat, friend messaging, or trading negotiations), you agree to be respectful and civil in all interactions. Harassment, hate speech, threats, or any form of abusive behaviour toward other players or our staff is strictly prohibited. This includes using offensive usernames, or profiles as well. We have zero tolerance for discriminatory language (e.g., racism, sexism), bullying, or any content that is obscene or extremely violent.

    Keep communications game-related and appropriate. If someone is violating these rules, you can report them to us. We may monitor and moderate chats or user-generated content to enforce these rules, but we generally do not read private messages unless a violation is reported.

  4. Trading Conduct: The game’s trading system (if active) lets players exchange Caps or items. When trading:

    • Do not scam or defraud other players. Both parties should honour the agreed trade. Using exploits to trick someone or not providing your side of the trade (if the system even allows non-simultaneous trades) is prohibited.

    • Only use the official in-game trading interface to trade. Trading outside (e.g., sending someone your login info in exchange for something) is forbidden and unsafe.

    • Do not create multiple accounts to self-trade or circumvent trade limits.

    • We are not responsible for trades that players agree to; trade at your own risk within the game’s rules. But if someone clearly scams using a loophole or violates terms, let us know and we will investigate.

  5. Impersonation and Fraud: Do not impersonate any other person, particularly our staff, moderators, or any celebrity/known figure. Also, do not falsely imply endorsement or partnership between us and any third party. If you pretend to be a Caps Studios employee to phish others or get free items, that’s a serious violation. Similarly, do not claim to “represent” the
    game to do shady things.

  6. Game Client and Network: You may not attempt to attack, disrupt, or overload the game servers or other players’ connections. This includes denial-of-service (DDoS) attacks, distributing viruses or malware through the game, or any attempt to interfere with the normal operation of Capss or the experience of other users. You also must not intercept or snoop on data from the game’s network traffic in a malicious way (packet sniffing for exploitation is not allowed, though using it for benign personal info like measuring ping is fine). Any attempt to circumvent security features or to access parts of the service not intended for users is prohibited.

  7. Multiple Accounts and Exploits: Unless expressly allowed, do not create multiple accounts to gain extra rewards (for example, making many alt accounts to farm beginner bonuses or to harass someone after your main is banned). If we detect a network of dummy accounts abusing systems, we may ban all related accounts. Also, if you discover a bug or exploit, please report it to us confidentially (you might even get thanks or a reward). Do not publicly post the exploit or continue to abuse it. As our Terms of Use reference suggests, intentionally exploiting bugs or distributing cheats is a violation.

  8. Compliance with Laws: You agree to follow all applicable laws and regulations while using Capss. This includes any local age ratings or content regulations. For example, if there is a law in your country about limiting playtime for minors at night, we expect you to honour that (we might not enforce it technologically unless required, but the responsibility is on you). Also, do not use the game for any unlawful activities – the game should not be used as a platform for anything illegal (e.g., you cannot use chat to coordinate crimes, etc., obviously).

  9. Reporting and Enforcement: Caps Studios reserves the right to monitor player activity and content to enforce these rules. However, we do not guarantee we will catch every violation. We encourage players to use in-game report tools or contact support if you encounter someone violating the Code of Conduct. We will review reports and take appropriate action: this can range from a warning, temporary suspension (“mute” from chat or a ban from trading for a while, for instance), up to permanent account ban for serious or repeated offenses. In extreme cases (such as threats of real-life harm or evidence of criminal activity), we may involve law enforcement.

    We aim to be fair and will typically warn or temporarily ban for first-time minor offenses. But cheating or extreme harassment can result in immediate permanent ban without warning. Banned users forfeit any unused virtual currency or items (no compensation).

  10. Appeals: If you believe your account was wrongfully sanctioned, you may appeal by contacting our support. We will review the situation. Our priority is to keep the game environment healthy, so while we’ll listen, our decisions (especially in clear cases of cheating) are final.

    Playing Capss is a privilege, not a right – we truly hope never to ban anyone, but maintaining an enjoyable community comes first.

5. User-Generated Content (UGC) and Community Guidelines

(This section applies if the game allows you to create or share content, such as posting on forums, uploading custom avatar images, etc. If Capss at launch doesn’t have such features, this section may be minimal, but we include it for completeness and future expansion.)

  1. Types of UGC: Capss might allow users to create certain content, for example:

    • Posting messages on an official Capss forum or community board.

    • Uploading a profile picture or making a custom profile bio.

    • Sharing fan content like fan art or strategies in designated community channels.

    • Future features could include designing custom cosmetic looks, etc.

    All such content that you (the user) create and share within our services or community channels is “User-Generated Content” and remains your responsibility.

  2. Ownership of UGC: You retain ownership of any original content you create (e.g., your written posts or drawings). However, by sharing it on our platforms, you grant Caps Studios a license to use, display, reproduce, and distribute your content in connection with the Game. This license is worldwide, non-exclusive, royalty-free, and sublicensable. It’s basically so we can show your content to other users (that’s the point of sharing) and possibly use it in promotions (for example, featuring a fan art on our official site or social media). We will credit you when feasible. This license ends when you remove the content or delete your account (but note, removal might not be immediate if others have already seen or if cached, etc., and doesn’t require us to recall any distributed material like a livestream it appeared in).

  3. Prohibited UGC: You may not post any content that violates the law, infringes anyone’s rights, or breaches these Terms. This includes:

    • Anything that is hateful, harassing, pornographic, excessively violent, or otherwise objectionable (see Code of Conduct above).

    • Any content that infringes someone else’s intellectual property. Don’t upload images or text you don’t have the right to use. (E.g., don’t post someone else’s artwork claiming it’s yours, and don’t share cheats or copyrighted material illegally.)

    • No spamming or advertising. The community spaces are not for promoting unrelated products or services. (An exception might be if we allow fan content creators to share their fan sites or streams in a designated area – but follow the guidelines given.)

    • Don’t reveal personal information of others (doxing) or yourself excessively. Protect your privacy and that of others. No posting of phone numbers, addresses, etc. in public chats.

    • No malicious code – obviously don’t post any links or files that contain viruses, malware, or phishing.

    We (or community moderators) reserve the right to remove or edit UGC that violates these rules, and to sanction accounts responsible.

  4. Feedback and Suggestions: If you provide us with any suggestions, ideas, or feedback about Capss (for example, through forums or directly emailing ideas), you acknowledge that this feedback is given voluntarily and we are free to use it as we see fit, without any obligation to you. We appreciate feedback, but we likely are working on similar ideas already. You won’t be compensated for ideas, and we won’t be bound to implement them. See section in the EULA that might cover feedback IP in Beta.

6. Intellectual Property Rights

  1. Caps Studios’ Ownership: All rights, title, and interest in and to the Game and all content within the Game (except for your own UGC as noted) are owned by Caps Studios Ltd or its licensors. This includes the game software, code, title, graphics, artwork, characters (“Caps”), animations, sounds, music, audiovisual effects, logos, and the overall design and gameplay of Capss. Everything from the legendary Cap characters you collect to the pack artwork and the user interface is protected by copyright, trademark, and other intellectual property laws. Caps Studios retains all rights not expressly granted to you.

  2. Limited License to You: When you play Capss, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Game and its content for your individual, non-commercial entertainment purposes only, subject to these Terms and the EULA. You do not “own” the digital items or Caps on your account; rather, you have a limited right to use them within the Game, under the conditions of this Agreement. This license is also conditioned on your compliance with the Terms. If you breach the Terms, this license can be revoked (meaning we can terminate your access).

    You may not use our content outside the Game except as expressly allowed. For example, you can’t take our artwork and sell merchandise, nor can you distribute our game client or server code.

  3. No IP Infringement: You agree not to infringe or violate our intellectual property rights or those of any third party. This means:

    • Do not copy or reproduce parts of the Game except as allowed (like cached copies on your device by normal use).

    • Do not create derivative works based on our game content. (Fan art and fan fiction are generally fine – we love fan creativity and usually consider it fair use, as long as you’re not making money off of it in a way that competes with us. But do not, say, create a separate game using our characters or use our art in another product.)

    • Do not reverse engineer or extract source code (as mentioned before).

    • Do not remove or obscure any copyright, trademark, or other proprietary notices in the Game. For instance, if there are logos or legal lines in the app, don’t try to hide them if you stream or screenshot.

    • All Caps Studios and Capss logos, names, and assets are our trademarks. You can’t use our trademarks in a way that confuses others as to an official endorsement (for example, you can’t name a fan tournament “The Official Capss Championship” without permission). If you run a fan site, you should include a disclaimer that it’s not official.

  4. Streaming and Content Creation: We know many players may want to stream Capss gameplay or create videos/content about the game. We permit streaming and content creation, with some conditions: You may livestream or upload videos of your gameplay to services like Twitch, YouTube, etc. once the game is officially launched to the public. (Streaming or sharing content from any pre-release/beta version is NOT allowed – see Beta Agreement.) After launch, you have our permission to capture in-game footage and audio for the purpose of sharing gameplay, walkthroughs, reviews, or commentary, so long as you do so in a non-commercial manner and comply with these Terms and any additional Fan Content Guidelines we may publish. “Non-commercial” here means you can monetize via standard platform programs (like YouTube ads or Twitch partner program) but you cannot, for example, sell the footage itself or charge people specifically to watch Capss content. Also, you must not claim your fan content is official or endorsed by us when it isn’t. We retain the right to revoke this permission for individuals if necessary (for example, if someone’s using our content in a negative, grossly inappropriate way).

    In summary: Yes, feel free to stream and make videos after release – it’s free advertising for us and fun for the community – just keep it clean and legal. If you misuse our content, we can ask platforms to take it down (DMCA etc.), but we hope that won’t be necessary.

  5. Beta Content Confidentiality: Any content from closed beta or testing phases is confidential until we release it publicly. Beta testers are not allowed to share or distribute beta-specific content (see Beta Agreement). If you have access to unreleased features, do not include them in public content until they’re officially in the public version/changelogs.

  6. Violations: Unauthorised use of Caps Studios’ intellectual property may result in civil or criminal liability. We hope to never get to that point – usually a cease-and-desist letter or DMCA notice is enough if someone infringes. But we reserve all rights to protect our IP.

7. Updates and Changes to the Service

  1. Patches and Updates: Capss is an online evolving game. We may release updates, patches, or new content from time to time to improve the game, add features, rebalance gameplay, or fix bugs. You consent to the automatic downloading and installation of updates to your device. (On mobile, you might have auto-update on or you may need to accept updates via the app store – but to continue playing, you’ll need the latest version as we may disable old versions for compatibility). We will ensure updates are reasonably sized and not overly frequent so as not to burden your device.

  2. Changes to Terms or Game: We reserve the right to modify these Terms or the game rules/features over time. If we make material changes, we will notify you (e.g., via app notification or email or a prominent announcement). Continued use of the Game after changes signifies your acceptance of the new Terms. If you don’t agree, you should stop using the Game. We will include an “Last Updated” date at the top of Terms when we change them.

    We may also change in-game features. For example, we might modify how the Season Pass works in a new year, or change the cost of items, or even discontinue certain modes if necessary. We’ll try to communicate major gameplay changes via patch notes or in-game news. We are not obligated to continue supporting the game indefinitely (see Termination below), but we are passionate about it and plan to support it for as long as it has an active community.

8. Termination and Suspension

  1. Your Right to Stop: You have the right to stop using Capss at any time. You can delete the app and, if you wish, contact us to delete your account/data (see Privacy Policy for data deletion). Keep in mind that if you uninstall without linking an account, you might lose progress. If you’re dissatisfied or want to take a break, that’s okay – you can return anytime as long as your account remains active.

  2. Our Right to Terminate/Suspend: We may suspend or terminate your access to the Game (temporarily or permanently) under certain circumstances:

    • If you violate any of these Terms or the EULA or Beta Agreement (material breach, especially cheating or abuse, will likely result in termination).

    • If required by law or directed by law enforcement or other government agencies.

    • If we discontinue the game service entirely (shutdown).

    • For extended inactivity (though generally we won’t delete accounts just for inactivity without warning).

    • If technical issues or maintenance require it (suspension for maintenance is usually temporary downtime).

    We will endeavour to give notice if we terminate your account, explaining the reason, unless it’s an urgent case or legally prevented. Minor violations might result in temporary bans (e.g., chat ban for a week), whereas major or repeated violations can result in permanent account ban. A banned account means you lose access to it and all progress/items on it (no compensation for virtual items lost due to a ban).

  3. Discontinuation of Service: Caps Studios reserves the right to discontinue or sunset Capss at any time. If we decide to end the game service, we will give players as much advance notice as reasonably possible (for example, an announcement that in 3 months the servers will shut down). During that time, we may disable purchases and allow you to use up any remaining currency. After the shutdown date, the game will no longer be playable. We do not guarantee any specific length of service, but we commit that we have no plans to shut it down in the foreseeable future as long as players are enjoying it.

  4. Effect of Termination: Upon termination of your account or the game service, the license granted to you to use the game ends. You must cease any further use of Capss. We may delete or wipe your account data (except that we may retain certain data for legal purposes or as outlined in the Privacy Policy). If you were terminated for cause (violation of terms), you are not entitled to any refunds of unused virtual currency or other compensation, to the fullest extent permitted by law. If we terminated service without cause (like general shutdown), we will follow any legal requirements regarding refunds. (For instance, some regions might require refunds of unused in-game currency in a shutdown scenario; we’d comply if applicable.)

    Any provisions of these Terms that by their nature should survive termination (such as indemnity, disclaimers, liability limits, governing law) will remain in effect.

9. Disclaimer of Warranties

  1. “As Is” Service: Capss and all related services are provided on an “AS IS” and “AS AVAILABLE” basis. While we strive for a high-quality experience, Caps Studios disclaims all warranties and representations, express or implied, regarding the Game. This includes any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

    We do not guarantee that:

    • The game will be available at all times, or uninterrupted, or error-free. (We might have downtimes, maintenance, or unexpected outages.)

    • The game will be free from bugs or defects (though we work hard to fix them). You acknowledge that no software is perfect and you may encounter bugs.

    • The gameplay experience will meet your expectations. (We hope it does, but we can’t promise you’ll find it fun or that a certain feature will exactly suit you.)

    • Any specific outcomes or rewards. (Randomness is part of the game as described; you are not guaranteed to get a specific rare Cap except by chance or special events per design.)

  2. No Warranty on Virtual Goods: We make no warranty that virtual currency or items will have any real-world value or that we will continue to offer any particular item indefinitely. They exist only under these Terms.

  3. Beta and Compatibility: If you are using any beta or early access version, you especially acknowledge it’s pre-release and likely contains issues. Even on release, the performance may vary by device. We do not warrant that Capss will function on every device or with every OS version – check the app store listing for supported specifications. We aren’t responsible for issues arising from running on a jailbroken/rooted device or on an emulator or otherwise unsupported environment.

  4. Third-Party Services: Caps Studios is not responsible for any third-party services or platforms you use to access the game. For example, we don’t warrant the performance of Apple’s App Store, Google Play, or your internet provider. Any issues or warranties relating to those are between you and that provider.

    In jurisdictions that do not allow the disclaimer of certain warranties, our disclaimer will apply to the fullest extent permitted. You may have specific legal rights that this section cannot override. For instance, under UK consumer law, digital products must be as described, of satisfactory quality, and fit for purpose. If Capss is not, you’re entitled to certain remedies (like repair or replacement). Nothing here is meant to limit those statutory rights if they apply. We simply need to state that outside of required guarantees, we provide the game as-is.

10. Limitation of Liability

  1. No Liability for Indirect Damages: To the maximum extent permitted by law, Caps Studios Ltd and its directors, officers, employees, and agents will not be liable to you for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of (or inability to use) Capss or any aspect of these Terms. This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses, even if we have been advised of the possibility of such damages.

  2. Cap on Liability: To the extent we are found liable notwithstanding the above, our aggregate liability to you (for all claims combined) is limited to the amount (if any) that you have paid to us in the 6 months immediately before the claim (for example, your spending on in-app purchases in that period), or £50 GBP, whichever is higher. If you haven’t paid anything (free user), we would aim to fix the issue but financial liability would be minimal or nil.

  3. Exceptions: Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability which cannot be limited or excluded under applicable law (for example, certain consumer protection liabilities under law). The limitations above apply to the extent permitted. For instance, some countries do not allow exclusion of liability for gross negligence or willful misconduct, so if applicable, we wouldn’t exclude that in your case.

  4. Your Responsibility: You assume all risks associated with your use of the Game. We are not responsible for any damage to your device or loss of data that results from use of the Game (so please back up your data and use appropriate security on your device). We also aren’t liable for any issues or injuries resulting from you breaking the rules (e.g., if you meet someone through the game and decide to trade outside and get scammed, that’s unfortunately on you since it was outside our service scope).

  5. Indemnification: You agree to indemnify and hold harmless Caps Studios and its affiliates/employees from any claims, losses, liabilities, demands, or expenses (including legal fees) arising out of your breach of these Terms or violation of any law or right of any third party. For example, if you cheat and a third party brings a claim because of it, or if you upload content you don’t have rights to and we get sued, you’ll cover us. We’ll notify you of any such claim and cooperate reasonably in defense. This obligation survives termination of your use of the game.

11. Governing Law and Dispute Resolution

  1. Governing Law: These Terms (and any non-contractual disputes/claims arising out of or in connection with them) are governed by and construed in accordance with the laws of England and Wales. We choose UK law given our company location. However, if you are a consumer in an EU country (like Cyprus), you also benefit from any mandatory provisions of the law of your country of residence. This means that nothing in these Terms will override any rights you have under local consumer laws that by law cannot be waived.

  2. Jurisdiction: You and Caps Studios agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Game. If you are a consumer resident in Cyprus or elsewhere, you may also have the right to bring proceedings in your local courts under consumer protection rules. This jurisdiction clause does not deprive you of any protection afforded to you by consumer laws of your resident country.

  3. Dispute Resolution and Arbitration (if applicable): (If we wanted arbitration for other regions, we’d include it, but since specifically UK and Cyprus, we’ll stick to court unless decided otherwise.) Currently, we have not mandated arbitration in these Terms. Any disputes will be resolved through the courts as above, unless an alternative dispute resolution mechanism is required by law or agreed upon mutually.

  4. Informal Resolution: We encourage you to reach out to us first to resolve any concern. Our support team is often able to address issues without legal action. We believe most disputes can be solved through communication – we’re reasonable folks and hope you are too.

12. Miscellaneous

  1. Entire Agreement: These Terms, along with the Privacy Policy, EULA, and any other documents expressly incorporated (like the Beta Agreement if you are a tester), constitute the entire agreement between you and Caps Studios regarding the Game. They supersede any prior agreements or understandings (whether oral or written) about the Game. Any additional or conflicting terms you propose (for example in a purchase order or via communications) are rejected unless explicitly agreed by us in writing.

  2. Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from the Terms and will not affect the validity and enforceability of the remaining provisions. We can replace the invalid provision with a valid one that closest matches the intent and economic effect.

  3. No Waiver: Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision. For example, if you break a rule and we don’t act immediately, it doesn’t mean we can’t act if it happens again or later. Any waiver must be explicit and in writing to be effective.

  4. Assignment: Caps Studios may assign or transfer these Terms (in whole or part) to another entity as part of a merger, acquisition, or sale of assets, or by operation of law. You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent – any attempt to do so without consent is void.

  5. No Third-Party Beneficiaries: These Terms are between you and us. No other person shall have any rights to enforce any term, except as specifically stated in the EULA section regarding platform providers (Apple/Google) being third-party beneficiaries for certain EULA provisions. Other than that exception, these Terms do not confer any third-party beneficiary rights.

  6. Force Majeure: Caps Studios is not liable for any failure or delay in performance of our obligations (like keeping the game running) if caused by events beyond our reasonable control, such as war, terrorism, natural disasters, power/internet outages, epidemic/pandemic, or acts of government.

  7. Language: These Terms are provided in English. If we provide translations, the English version will govern in case of any conflict or ambiguity in translation.
